This includes the sending of Spam Email with an opt out clause such as "Click here to be removed from this mailing list" Any accounts using our services, or using the services of any ISP, for sending Spam Email or unsolicited Bulk Email of any type, to promote a site hosted by australianwebsites.com may be immediately terminated without refund. 2. Content hosted by australianwebsites.com The owner of australianwebsites.com is not responsible for any claims resulting from the use of our service and does not allow storage of : including, but not limited to the following: Illegal Material - This includes copyrighted works, commercial audio, video, graphic, or music files and any material in violation of any Australian or international law. Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etcetera, and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material. Offensive Material - Any material which, at the discretion of the management of australianwebsites.com may cause reasonable offense or upset to others. You acknowledge that the management of australianwebsites.com shall have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via our Hosting services. Without limiting the foregoing, the management of australianwebsites.com shall have the right to remove any content that violates the Terms & Conditions or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content. 3. Copyright and Infringements The customer is liable for all actions of any copyright or trademark infringements conducted on their sites and contents. The customer acknowledges the Copyrights Act and agrees that it shall defend, save and hold the owner and management of australianwebsites.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable lawyer's fees asserted against the owner and management of australianwebsites.com 4. Server Whilst every effort is made to ensure that Hosting provided by australianwebsites.com is of the best possible reliability, you agree that the owner and management of australianwebsites.com shall not be held responsible for any loss of business due to server down time or data loss in the provision of its services. 5. Refunds If you are paying for your Web Hosting Account by a subscription through the Pay Pal links on our site the subscription will automatically renew each time it falls due for renewal, yearly for example. If you request a refund of a renewal payment within 8 weeks of a renewal payment, a full refund will be given if no more than 4 days has elapsed since the renewal date, or if more than 4 days has elapsed since the renewal date, a full prorata refund will be given, the amount calculated on how many days credit remains in the current billing period. Please allow 3 working days for a requested refund to be processed. If a billing dispute is raised unnecessarily, ( that is, less than 3 working days after a request to us for a refund was made ) with our payment processor, Pay Pal, we reserve the right to deduct an administrative fee of $44 from a refund, to cover the extra administrative time involved in liaising with Pay Pal. Also a refund will not be guaranteed as in the paragraph above, but for any billing issues raised with Pay Pal will be dependent on the decision made by Pay Pal and we will abide by the decision made by Pay Pal. 6. Non Payment If your Web Hosting Account is unpaid and remains unpaid after payment reminders are issued your Web Hosting Account and domain name may go into suspended status until payment is made. Disclaimer The owner and management of australianwebsites.com will not be responsible for any damages or loss of data your business may suffer. The owner and management of australianwebsites.com makes no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes registration failure and lapse of domain registration. It is the customer's responsibility to ensure renewal of their domain names before expiry. The management of australianwebsites.com reserves the right to revise its policies at any time. These Terms and Conditions may be modified at any time and without notice. All account owners, previous and new are always subject to the latest Terms and Conditions posted here at all times. |
